At Davis Reierson, we have deep roots in the practice of family law and are highly skilled in dealing with all matters related to separation and divorce. From negotiating settlements to managing complex litigation, our team has the skills and experience needed to assist clients in navigating the personal and financial complexities related to the end of their relationship.
One of the most difficult and emotional issues following separation is arranging for the ongoing parenting and custody of the children. Ideally, we are able to assist clients in reaching an agreement on parenting issues based upon what is best for their children. When settlement is not possible, we are always prepared to litigate the issue on behalf of our clients to ensure that the best interests of the children are being met.
The Child Support Guidelines make the issue of child support straightforward in some cases. In other cases, the parenting schedule, method and level of income of the parties, ages of the children, the sharing and types of children's expenses, and other factors can make the issue anything but straightforward. We can help to sort out how the Guidelines apply to our client's specific circumstances, and provide advice on negotiating and litigating child support.
Although we do have Spousal Support Advisory Guidelines, there is a wide variety in the application (and even use) of this tool. Spousal support is not guaranteed upon the breakup of a relationship, and entitlement must be proven (or agreed) before moving to calculating how much is to be paid and for how long. We have significant experience in assisting the potential payors and recipients of spousal support achieve the best outcomes in their circumstances.
The division of assets and debts can be a complicated issue. There are differences in the laws relating to married vs. common law spouses, and there are considerations relating to valuations, business assets, equal or unequal division, and other factors. Our team deals with these issues daily, and can provide clients with the advice they need to make informed decisions.
These are just the most typical issues our clients face. Other matters such as Variations, Cohabitation Agreements, Marriage Contracts, Mobility/Travel with Children, Adoption, and International Family Law Issues are all part of our regular practice. If you have another type of family law matter, we've likely dealt with it before. Please contact us to discuss.
